CUSMA certificate of origin

The document people search when they want the preferential rate. It proves origin. It does not, by itself, take a Section 232 metal duty off the entry.

What is a CUSMA certificate of origin?

A CUSMA certificate of origin is the written claim that a good qualifies for preferential tariff treatment under the Canada–United States–Mexico Agreement. It is evidence that the good meets the rule of origin. It is not a licence to import, and it is not a refund claim.

Searchers still say “certificate” because that was the NAFTA paper. Under CUSMA the instrument is a certification of origin. The job is the same: someone responsible states, in writing, that the good is originating, and the importer holds that statement when the preference is claimed.

Is there an official CUSMA certificate form?

No. CBP does not prescribe a CUSMA certificate of origin form the way NAFTA did. The certification can sit on the invoice or on a separate document. What matters is the minimum data elements, not a government template.

If a broker or a buyer sends you “the CUSMA form,” treat it as their house format. Check that the data elements are there and that the person who signed it is allowed to certify. A missing official form is not the defect. An unsigned or incomplete certification is.

Who can certify origin?

The exporter, the producer, or the importer can complete a CUSMA certification of origin. The importer who claims the preference must have the certification in hand at the time of the claim, even when someone else signed it.

For a Canadian mid-market shop the practical split is this: the plant that knows the bill of materials should certify, and the importer of record on the US entry is the one who uses it. If those are two companies, the file has to travel. Incoterms do not move that duty.

What the certificate does

A complete CUSMA certification lets the importer claim the Agreement rate on goods that actually originate. On many industrial and consumer lines that is the difference between a duty and no duty. On some lines it is the difference between a stacked rate and a lower one.

A blanket certification can cover more than one shipment of the same goods, for a period that does not exceed twelve months. It still has to be true of every shipment it covers. If the bill of materials changes, the blanket is stale.

What the certificate does not do

A CUSMA certificate does not remove Section 232 duties on core steel, aluminium or copper articles. Origin does not waive that authority. It also does not create an IEEPA refund, and it does not decide who is the importer of record.

This is the mistake the search is built on. People type “cusma certificate” hoping the paper clears the border. On a core 232 metal article the paper changes nothing about that duty. On a listed derivative it can change how the 25% is applied. Read the register before you promise a customer that origin “covers it.”

CUSMA origin and Section 232 derivatives

On listed Section 232 derivative articles, documented CUSMA origin can change the math: 25% on non-US content, 0% on US content up to 40% of value, with an effective duty not less than 15%, through 31 December 2027.

That overlay is on the working register and cited to the June 2026 adjustment. It is not a reason to skip the certification. It is a reason to know whether the SKU is a core article, a derivative, or under the 15% metal de minimis before anyone signs.

What if the file is incomplete?

If origin cannot be evidenced, treat the goods as non-qualifying. That is the cost you are exposed to until the certification is complete. “Not sure” is not a third rate. It is the full rate.

CBP can ask for the certification and follow-up support after entry. If the producer cannot show the rule of origin, the preference is denied and the duty is due. Build the file before the truck, not after the protest.

Factual answers

Are CUSMA, USMCA and ACEUM the same thing?
Yes. CUSMA is the Canadian name, USMCA the American name, ACEUM the French name. One agreement. The certification of origin is the same instrument.
Does a CUSMA certificate remove Section 232 tariffs?
Not on core metal articles. Those stay under Section 232 even when the good originates. On listed derivatives, documented origin can change how the 25% is applied and can put a 15% floor under the effective rate, through 31 December 2027. Confirm the SKU against the annex before you price it.
Can a Canadian company be the one who certifies?
Yes, if it is the exporter or the producer. The US importer can also certify. Whoever claims the preference on the entry must hold the certification. A Canadian seller on DDP terms who is not the importer of record does not automatically own the claim or the refund.
How long does a CUSMA certification last?
A certification can cover a single shipment or, as a blanket, a period of up to twelve months for the same goods. Keep it with the entry file. Replace it when the product, the plant, or the bill of materials changes.
